Chapter 7  Bankruptcy in Illinois

Chapter 7 is designed for people in financial difficulty who do not have the ability to pay their debts. People whose debts are  not business debts are subject to a “Means Test” designed to determine if they qualify for chapter 7 or if they must file a chapter 13 bankruptcy instead.

The purpose of filing a chapter 7 bankruptcy is to obtain a discharge of your debts. Some debts are not discharged under Illinois bankruptcy law.

Chapter 13 Bankruptcy in Illinois

Chapter 13 is designed for individuals with regular income who desire to pay part or all of their debts, often a little as 10%, in installments over a period of time. Under chapter 13, you must file with the court a plan to repay your creditors some or all of the money that you owe them, using your future earnings. The court must approve your plan before it takes effect.

After completing the payments under your plan, your debts are generally discharged except for certain debts under Illinois bankruptcy law.
