Chapter 7

Illinois bankruptcy attorney fees for all Chapter 7 bankruptcy cases must be paid up front – Period!

This makes sense because in a Chapter 7 bankruptcy a promise made before filing the case to pay attorney fees after filing makes the promise dischargeable, i.e. you do not have to pay the attorney and it is illegal for the attorney to ask you for the money.  Any attorney who will take some money up front and the rest after your case is filed is breaking the law.

Chapter 13

Illinois bankruptcy attorney fees for Chapter 13 bankruptcy cases can be paid either before the filing or as part of the repayment plan. For Chapter 13 cases, the installment payment plan is the preferred choice of most clients since it requires less up-front cash.
